The agreement between you and Swastho.

1. Acceptance

By creating an account or using Swastho you agree to these terms and to our privacy policy. If you do not agree to them, do not use the platform.

If you are accepting on behalf of a clinic or other organisation, you confirm you are authorised to bind it, and “you” in these terms means that organisation.

2. Eligibility

You must be at least 18years old to hold an account. A parent or legal guardian may hold an account and use it to book appointments and keep records for a child in their care; the account and the responsibility for it remain the adult’s.

You must provide accurate information and keep it current. Doctor and clinic accounts must be registered by the practitioner or the operator of the clinic, not by a third party on their behalf.

3. What Swastho is, and is not

Swastho is a scheduling and record-keeping platform. It lets a patient find a clinic and book an appointment, lets a clinic run its queue and raise a bill, and keeps prescriptions, bills and reports in one place.

4. Your account

• One email address supports one sign-in method. If you created your account with a password you sign in with that password; if you created it through Google you sign in through Google. This keeps a single account from having two doors.
• Keep your password and your device secure. You are responsible for anything done through your account.
• Your QR code identifies you and does not change. Show it only to a clinic or doctor you are consulting, and tell us if you think someone else has captured it.
• Tell us promptly if you believe your account has been accessed by someone else.

5. If you are a patient

• Give accurate health information — allergies, chronic conditions and your reason for visit are read by the clinician treating you, and an inaccuracy there can matter.
• Attend the appointments you book, or cancel them so the slot can be released to someone else.
• Pay the clinic for your consultation directly. See section 8.
• Upload only your own medical records, or those of a person in your care.

6. If you are a doctor

• You warrant that you hold a valid registration with the relevant medical council, that it is current, and that you practise only within its scope and within your qualifications.
• You are solely responsible for the clinical content of every prescription you submit — including one started from an AI draft. Submitting is the clinical act.
• Keep your schedule and holidays accurate. A patient books against what you publish.
• Access a patient record only for the purpose of treating that patient.

7. If you are a clinic

• You warrant that your GST number and registration number are accurate and that you are lawfully entitled to operate.
• Where you book a walk-in, upload a report, or record vitals for a patient, you confirm you have that patient’s consent to do so and that the data is accurate.
• Bills you raise must reflect the care actually provided. You are responsible for their accuracy and for collecting payment.
• Keep your operating hours, holidays and doctor associations current, and deactivate an association when a doctor stops practising with you.

8. Billing and payments

The bill for a consultation is an agreement between the clinic and the patient. Swastho records it so both sides can see the same numbers — it does not set fees, does not process payments, and never holds your money. Payment is made to the clinic directly, by whatever means the clinic accepts.

Swastho is free to use. We charge patients, doctors and clinics nothing for the platform. A dispute about an amount charged is between you and the clinic; we can show you what was recorded, but we cannot adjudicate it.

9. AI features

A doctor may ask the platform to draft a prescription from a typed prompt or a dictation. The draft is a suggestion that populates an editable form; nothing reaches the medical record until the doctor reviews and submits it.

10. Acceptable use

You agree not to:

• Access, or try to access, a record that is not yours or not yours to treat.
• Scrape, crawl, bulk-download or systematically extract data from the platform.
• Probe, scan or test the security of the platform, or interfere with its operation.
• Impersonate another person, or register a doctor or clinic account you are not entitled to hold.
• Upload malware, or a file that is not what it claims to be.
• Use the platform to harass anyone, or for any unlawful purpose.
• Resell, sublicense or commercially exploit the platform or anything obtained through it.

11. Availability and warranties

We work to keep Swasthoavailable and correct, but we provide it “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or that any particular appointment, queue position or reminder will reach you on time.

Keep your own copy of anything clinically important. The platform is a convenience, not your only record.

12. Limitation of liability

To the fullest extent permitted by law, Swastho is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, arising from your use of the platform.

In particular, and because it is the point people most often assume otherwise: we are not liable for the clinical care you receive, for a diagnosis or prescription given by a doctor, for a clinic’s conduct or fees, or for a decision you take on the basis of anything shown on the platform.

Nothing in these terms excludes liability that cannot be excluded under Indian law. You agree to indemnify us against claims arising from your breach of these terms or your misuse of the platform.

13. Suspension and termination

We may suspend or close an account that breaches these terms, that we reasonably believe is fraudulent or impersonating someone, or where we are required to by law. Where we can, we will tell you why.

You may stop using Swastho at any time. To close your account, write to support@swastho.in — there is no in-app control for this yet, and the privacy policy explains what happens to your data when you do.

14. Governing law

These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising from them or from your use of Swastho.

15. Changes to these terms

We may update these terms. The “last updated” date at the top always reflects the current version, and where a change materially affects you we will tell you before it takes effect. Continuing to use the platform after that point means you accept the updated terms.
